These Terms of Service (“Terms”) govern the use of https://elnuevoneighborhood.com/ (the “Site”) and purchases made through our online store.

The website operates under the customer-facing name El Nuevo Neighborhood Pet Shop and is operated by EL NUEVO NEIGHBORHOOD PETSHOP CORP, a Florida corporation registered under document number P17000069250.

Throughout these Terms, “El Nuevo Neighborhood Pet Shop,” “we,” “us,” and “our” refer to EL NUEVO NEIGHBORHOOD PETSHOP CORP, the legal entity responsible for operating the website and selling products through the online store.

Please read these Terms before placing an order. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

EL NUEVO NEIGHBORHOOD PETSHOP CORP operates the Site and is the seller for every order placed on it.

2. Who can order

You must be at least 18 years old to place an order, or have the permission and involvement of a parent or legal guardian. By placing an order, you confirm that the information you give us is accurate and that you are authorized to use the payment card you provide.

3. Accounts

You can check out as a guest or create an account. If you create an account, you are responsible for keeping your password confidential and for activity under your account. Please contact us if you believe someone has used your account without permission.

4. Products and product information

We sell new bird toys and pet accessories, including products for chewing, foraging, shredding and interactive play. Our product range changes over time: we add new products and pet categories, and products may be discontinued or become unavailable. The products shown in our shop at any time are the products currently offered.

We describe each product, including its materials and size, as accurately as we can. Product images show the products we sell, but colors can look different from one screen to another, and natural materials such as wood grain, loofah, palm and vine vary slightly from piece to piece, so the item you receive may differ a little from the photos. These natural variations are not defects.

5. Orders and acceptance

When you place an order, you are making an offer to buy the items in your cart. The order confirmation email we send after checkout confirms that we have received your order. It does not mean we have accepted it. We accept your order when we send you the shipping confirmation email.

We may decline or cancel an order, in whole or in part, for reasons such as an item being out of stock, a pricing or listing error, or suspected fraud. If we cancel an order after you have been charged, we refund the full amount, including shipping, to your original payment method.

6. Prices and payment

All prices are in US dollars (USD). We accept Visa, Mastercard, American Express and Discover, processed by Stripe. Your card is charged when you place your order. Your total at checkout is the item prices, plus the USPS shipping charge for the method you choose, plus any applicable sales tax. Prices on product pages do not include sales tax. For orders delivered to an address in Florida, we collect Florida sales tax (6% state tax plus the county surtax of the delivery address), calculated on the items and the shipping charge. We do not currently collect sales tax on orders delivered outside Florida. Any sales tax is shown as separate lines at checkout before you pay. Nothing else is added, and there are no surcharges for any card type.

If an item was listed at an incorrect price, we will contact you before shipping, and you can confirm the order at the correct price or cancel it for a full refund. Prices may change, but the price you paid at checkout is the price for your order.

7. Shipping

We ship with USPS only, to all 50 US states, Washington D.C. and APO/FPO/DPO military addresses. We do not ship internationally or to US territories at this time. Shipping is a flat rate per order:

Orders are processed within 1 to 2 business days. Alaska, Hawaii and APO/FPO/DPO addresses may need 2 to 4 additional business days. Delivery times are estimates, not promises. Full details are in our Shipping Policy, which forms part of these Terms.

8. Title and risk of loss

Ownership of the items you buy (title) and the risk of loss pass to you when the order is delivered. If a parcel is lost or damaged before delivery, we will send a replacement or a refund as described in our Shipping Policy.

9. Returns, refunds and cancellations

You can return items within 30 days from the date your order is delivered. New, unused items can be returned for any reason. Items that are defective, damaged or not what you ordered can be returned in any condition within the same 30 days, and we refund the original shipping charge as well. We cover the return shipping cost for every return with a prepaid USPS return label, and we do not charge restocking fees. For hygiene and bird-health reasons, a toy a bird has used can only be returned if it is defective, damaged or not what you ordered.

10. Bird safety and proper use

Our toys are made for pet birds. Please:

  • Choose a toy that is the right size for your bird. Our current toys are sized for small and medium birds such as budgies, lovebirds, cockatiels and conures.
  • Supervise your bird with a new toy, especially at first.
  • Inspect toys regularly and remove or replace any toy that is worn, frayed, cracked or has loose parts.
  • Keep our toys away from children. They are bird toys, not children’s toys.

11. Warranties

We do not offer a separate written warranty on our products. Any implied warranties apply as provided by law. If an item is defective, it is covered by our Return & Refund Policy, and we will replace or refund it.

12. Limitation of liability

To the extent permitted by law, EL NUEVO NEIGHBORHOOD PETSHOP CORP is not liable for indirect, incidental, special or consequential damages arising from your use of the Site or our products, and our total liability for any claim relating to an order is no more than the amount you paid for that order. Nothing in these Terms reduces or excludes any liability or any right that applicable law does not allow to be reduced or excluded.

13. Customer reviews

If we display product reviews, we accept them only from verified buyers and ask that they be honest. We do not edit reviews, pay for reviews or hide reviews because of their rating. We may remove a review that is abusive, off-topic or contains personal information.

14. Intellectual property

The content of the Site, including text, images, the El Nuevo Neighborhood Pet Shop name and our logo, belongs to EL NUEVO NEIGHBORHOOD PETSHOP CORP or is used with permission. You may view and print pages for your personal use. You may not copy, reproduce or use our content, name or logo for any other purpose without our written permission.

15. Prohibited uses

When using the Site, you agree not to:

  • Place orders using false information or a payment card you are not authorized to use
  • Use the Site for any unlawful or fraudulent purpose
  • Try to gain unauthorized access to the Site, its servers or other customers’ accounts
  • Interfere with the operation or security of the Site, including by introducing malicious code
  • Use automated tools to copy content from the Site or to place orders
  • Post reviews or messages that are abusive, misleading or contain other people’s personal information

We may suspend access or cancel orders connected with these activities.

Our Privacy Policy explains how we collect, use and protect your personal information. It forms part of these Terms.

17. Governing law and disputes

If you have a problem with an order, please contact us first. Most issues can be resolved quickly by phone or email.

These Terms are governed by the laws of the State of Florida and applicable US federal law. Any legal dispute will be handled in the state or federal courts located in Miami-Dade County, Florida. You may also bring a claim in small claims court if it qualifies. These Terms do not require arbitration, and they do not waive your right to take part in a class action.

18. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the new version on this page with a new effective date. The Terms in effect when you place an order apply to that order.

19. Severability

If any part of these Terms is found to be unenforceable, the rest of the Terms remain in effect.

20. Entire agreement

These Terms, together with the policies they refer to (our Shipping Policy, Return & Refund Policy, Payment Policy, Privacy Policy and Legal Notice), are the entire agreement between you and us about your use of the Site and your orders.
